In this article, we propose the Fair Priority Model for COVID-19 vaccine distribution, and emphasize three fundamental values we believe should be considered when distributing a COVID-19 vaccine among countries: Benefiting people and limiting harm, prioritizing the disadvantaged, and equal moral concern for all individuals. The Priority Model addresses these values by focusing on mitigating three types of harms caused by COVID-19: death and permanent organ damage, indirect health consequences, such as health care system strain and stress, as well as (...) economic destruction. It proposes proceeding in three phases: the first addresses premature death, the second long-term health issues and economic harms, and the third aims to contain viral transmission fully and restore pre-pandemic activity. -/- To those who may deem an ethical framework irrelevant because of the belief that many countries will pursue "vaccine nationalism," we argue such a framework still has broad relevance. Reasonable national partiality would permit countries to focus on vaccine distribution within their borders up until the rate of transmission is below 1, at which point there would not be sufficient vaccine-preventable harm to justify retaining a vaccine. When a government reaches the limit of national partiality, it should release vaccines for other countries. -/- We also argue against two other recent proposals. Distributing a vaccine proportional to a country's population mistakenly assumes that equality requires treating differently situated countries identically. Prioritizing countries according to the number of front-line health care workers, the proportion of the population over 65, and the number of people with comorbidities within each country may exacerbate disadvantage and end up giving the vaccine in large part to wealthy nations. [A] With a title as enigmatic as The Open, the reader might well wonder, "the open what?" Is the (...) title's adjective to stand alone? Does it need no substantive to support it? This unfamiliar title is not what one might first guess—it is not an awkward translation from the work's original title. No substantive follows in the original, and none is meant to. The idea that gives Agamben's book its title is that of an openness which is unconditioned—and perhaps unconditional, an openness which is unspecified—and perhaps unspecifiable.If the answer to the question "the open what?" can be answered with no substantive, might we ask in what this opening occurs? Between what more substantive things has an indefinable space been opened? The first answer to the question can be found in the work's subtitle—Man and Animal. The open space in question is that which separates and distinguishes man from animal. Philosophers, anthropologists, social scientists, zoologists, chemists, taxonomists—and many others—have had no small difficulty in agreeing upon the matter.Philosophers have traditionally had a low opinion of animals [cf. de Fontenay]. Descartes had especially little respect for the minds of animals and influentially classified them as automata mechanica. As Agamben notes, the great naturalist and taxonomist Linnaeus responded to this assertion with the laconic rejoinder: "Descartes obviously never saw an ape" [cf. O 23/A 30; translation modified]. Philosophers have been more eager than taxonomists to put distance between themselves and the animals—and for this reason have been particularly interested in studying what separates man from animal. The last great philosophical attempt in this regard is that of Martin Heidegger. Despite his preference for the primordial, his openness to the woods and the wilderness, his opinion of animals' faculties was not much higher than that of Descartes. In his view, animals live in an environment in which they are receptive to various stimuli, but where they have nothing approximating what we call a "world"—animals are, as he claims, "poor in world" (weltarm)—or even "without world" (weltlos). They live in such intense and incessant proximity to their environment and its stimuli that they do not see the existential forest for the environmental trees. The emergence of the “4th Industrial Revolution,” i.e. the convergence of artificial intelligence, the Internet of Things, advanced materials, and bioengineering technologies, could accelerate socioeconomic insecurities and anxieties or provide beneficial alternatives to the status quo. In the post-Covid-19 era, the entities that are best positioned to capitalize on these innovations are large firms, which use digital platforms and big data to orchestrate vast ecosystems of users and extract market share across industry sectors. Nonetheless, these technologies also have the potential (...) to democratize ownership, broaden political-economic participation, and reduce environmental harms. We articulate the potential sociotechnical pathways in this high-stakes crossroads by analyzing cellular agriculture, an exemplary 4th Industrial Revolution technology that synergizes computer science, biopharma, tissue engineering, and food science to grow cultured meat, dairy, and egg products from cultured cells and/or genetically modified yeast. Our exploration of this space involved multi-sited ethnographic research in both the cellular agriculture community and alternative economic organizations devoted to open source licensing, member-owned cooperatives, social financing, and platform business models. Upon discussing how these latter approaches could potentially facilitate alternative sociotechnical pathways in cellular agriculture, we reflect upon the broader implications of this work with respect to the 4th Industrial Revolution and the enduring need for public policy reform. Increasingly through the 1990s, tobacco control advocates questioned the practice of public institutions investing in tobacco company stocks. The questioning was framed in at least three ways. First, is it ethical to fund public expenditures with profits from a product that causes addiction and disease? Second, is it sound social policy to derive public income from a product that increases healthcare costs and reduces worker productivity? Finally, is it sound fiscal policy to invest in an historically profitable industry facing multiplying (...) legal and regulatory challenges? While the tobacco industry preferred to restrict discussion to the fiscal question, and offered an affirmative answer, its position was weakened by depressed stock prices brought on by actions of the industry as much as by tobacco control activism. As part of a campaign to restore its credibility as an investment vehicle with public fund managers, Philip Morris (PM) commissioned a report from the influential investment managers/advisors Wilshire Associates. However, Wilshire had only recently conducted such a study for the Washington State Investment Board (WSIB), assuring the board that the value tobacco stocks added to an investment portfolio – if any – was too small to be measured. Nonetheless, within a year, Wilshire produced a report for PM which appeared to laud the investment value of tobacco and to dismiss tobacco-excluded investment alternatives. This paper examines how Wilshire produced apparently diametrically opposed reports for clients with different interests. It reveals a pattern of potential conflicts of interest among tobacco companies, financial analysis firms, investment authorities, and institutional fund managers. It demonstrates substantial violations of two generally accepted ethical principles of business consulting: veracity and transparency. (shrink)

Our aim in this paper was to establish an empirical evaluation for similarity effects modeled by Rubinstein; Azipurua et al.; Leland; and Sileo. These tests are conducted through a sensitivity analysis of two well-known examples of expected utility (EU) independence violations. We found that subjective similarity reported by respondents was explained very well by objective measures suggested in the similarity literature. The empirical results of this analysis also show that: (1) the likelihood of selection for the riskier choice increases (...) as the pair becomes more similar, (2) these choice patterns are consistent with well-known independence violations of expected utility, and (3) a significant proportion of individuals exhibit intransitive choice patterns predicted under similarity effects, but not allowed under generalized expected utility models for risky choice. This paper investigates why some companies give to charity and others do not. The study uncovers a strong relationship between the personal attitudes of the charitable decision maker and the firm's giving behavior. This relationship indicates that the human element of personal attitudes may interact and play a very important role in a firm's decision to become involved with philanthropic activities. The study also shows that firms who have a history of giving to charity cite altruistic motives for their behavior. (...) One of the central questions in both metaethics and empirical moral psychology is whether moral judgments are the products of reason or emotions. This way of putting the question relies on an overly simplified view of reason and emotion as two fully independent cognitive faculties whose causal contributions to moral judgment can be cleanly separated. However, there is a significant body of evidence in the cognitive sciences that seriously undercuts this conception of reason and emotion, and supports the view that (...) moral judgments are caused by a complex interplay of psychological mechanisms that are both cognitive and affective, but in a way that is not simply a function of the independent causal contributions of reason and emotion. This chapter explores how morality can be rational if moral intuitions are resistant to rational reflection. There are two parts to this question. The normative problem is whether there is a model of moral justification which can show that morality is a rational enterprise given the facts of moral dumbfounding. Appealing to the model of reflective equilibrium for the rational justification of moral intuitions solves this problem. Reflective equilibrium views the rational justification of morality as a back-and-forth balancing between moral (...) theory and moral intuition, and therefore does not require that individual moral intuitions be directly responsive to rational reflection. The psychological problem is whether human psychology actually implements the processes required for reflective equilibrium. The psychological problem is far more difficult, and requires appealing to a dual-process view of moral judgement that regards moral intuitions and moral theories as belonging to different mental systems. What role does moral reasoning play in moral judgment? More specifically, what causal role does moral reasoning have in the production of moral judgments? Recently, many philosophers and psychologists have attempted to answer this question by drawing on empirical data. However, these attempts fall short because there has been no sustained attention to the question of what moral reasoning is. This paper addresses this problem, by providing a general account of moral reasoning in terms of a capacity, and suggests how (...) this account of moral reasoning can provide a way forward in current debates. In the 1950s and 1960s, prominent institutional economists in the United States offered what became the orthodox theory on the obstacles to commercializing scientific knowledge. According to this theory, scientific knowledge has inherent qualities that make it a public good. Since the 1970s, however, neoliberalism has emphasized the need to convert public goods to private goods to enhance economic growth, and this theory has had global impacts on policies governing the generation and diffusion of scientific research and innovation. We critique (...) the foundational conceptualizations of scientific knowledge as either public or private by examining Germany’s treatment of scientific outputs as club goods. We then compare the relative impacts on social welfare of distinct United States and German approaches to food and agricultural research and innovation. We conclude with reflections on how these findings might contribute to a democratic debate on how best to manage scientific knowledge to enhance social welfare. (shrink)

We agree with Cesario's premise but reject his conclusion: Although experimental studies of racial stereotyping, weapons perception, and shoot decisions typically exclude real-world contextual factors and thus have limited relevance to race disparities, these excluded factors comprise systemic, institutional, and individual-level biases that are more likely to amplify racial disparities than negate them.

As efforts to commercialize university research outputs continue, critics charge that universities and university scientists are failing to live up to their public-interest purpose. In this paper, I discuss the distinctions between public-interest and private-interest research institutions and how commercialization of university science may be undermining the public interest. I then use Jürgen Habermas’s concept of communicative action as the foundation for efforts to establish public spaces for ethical deliberation among scientists and university administrators. Such ethical deliberation is necessary to (...) facilitate discussion on whether public-interest science should be the research university’s primary purpose and what institutional rules and resources are needed to honor that purpose. ProseIn a preface written for the French translation of his Infancy and History: The Destruction of Experience, Giorgio Agamben states that"every written work can be regarded as the prologue (or rather, the broken cast) of a work never penned, and destined to remain so, because later works, which in turn will be the prologues or the moulds for other absent works, represent only sketches or death masks." 1 This remark, which describes every work of art as a preface, does not simply refer to the impossibility of translating the all of life into a single work. Nor does it simply refer to those purely empirical obstacles which stand in the way of creation, preventing the work of art from attaining the plenitude it might have hoped for had not greedy wine-merchants, harrying tailors, and eloquent panderers distracted the Great Minds from their tasks. Instead, in returning every work of art to its originary hesitation, in evoking the oscillation between work and draft, effort and accomplishment, Agamben invokes a much richer and darker potentiality lying at the heart of the work. It is this richer and darker potentiality that constitutes the central concern of Agamben's thought and that gives its name to this collection. Yet what is named in this potentiality? What is the nature of the potentiality of which Agamben speaks? What is this potentiality the potential for?Before advancing in the investigation of this question, let us look briefly at what is gathered together under its name. In this collection of essays by a thinker of unquestionable brilliance one finds a number of axes. We provide a justification for political liberalism’s Reciprocity Principle, which states that political decisions must be justified exclusively on the basis of considerations that all reasonable citizens can reasonably be expected to accept. The standard argument for the Reciprocity Principle grounds it in a requirement of respect for persons. We argue for a different, but compatible, justification: the Reciprocity Principle is justified because it makes possible a desirable kind of political community. The general endorsement of the Reciprocity Principle, we will (...) argue, helps realize joint political rule and relationships of civic friendship. The main obstacle to the realization of these values is the presence of reasonable disagreement about religious, moral, and philosophical issues characteristic of liberal societies. Political liberals ask citizens not to appeal to certain considerations, including religious and philosophical convictions, in political deliberation. We argue that political liberals must include a demanding requirement of intellectual modesty in their ideal of citizenship in order to motivate this deliberative restraint. The requirement calls on each citizen to believe that the best reasoners disagree about the considerations that she is barred from appealing to. Along the way, we clarify how requirements of intellectual modesty relate to moral reasons for (...) deliberative restraint. And we argue against attempts to weaken our requirement of intellectual modesty by emphasizing those moral reasons. (shrink)

Environmental controversies are often framed as conflicts between environmentalist and antienvironmentalist positions. The underlying dimensions of ethics and justice tend to be overlooked. This article seeks to integrate insights from environmental ethics and sociological observations through a case study of a watershed conflict. A controversy emerged in the 1990s when residents of the New York City watershed filed a lawsuit to block NYC’s proposed regulations for the land surrounding the streams and reservoirs that supply NYC’s drinking water. The conflict was (...) resolved after NYC agreed to provide economic development funds to the watershed towns in exchange for accepting the regulations. An analysis of interviews with NYC watershed town supervisors reveals that the conflict was resolved because underlying competing theories of justice were addressed. This contradicts the popular narrative that an environmental conflict can be resolved when competing parties come to the realization that natural ecosystems provide valuable water-purification services. The primary objective was to review pediatric ethics consultations at a large academic health center over a nine year period, assessing demographics, ethical issues, and consultant intervention. The secondary objective was to describe the evolution of PECs at our institution. This was a retrospective review of Consultation Summary Sheets compiled for PECs at our Academic Health Center between January 2008 and April 2017. There were 165 PECs reviewed during the study period. Most consult requests came from the inpatient setting, with (...) the Pediatric and Neonatal Intensive Care Units being the highest utilizers. Consultation utilization increased over the study period. The most common patient age was less than one year. Physicians were most likely to request consultation. Patient Best Interest, Withholding/Withdrawing of Life Sustaining Therapy, and Provider Moral Distress were ethical issues most commonly identified by the consultants. Making recommendations was the most common consultant intervention. The ethics consultation process evolved over time from informal provider discussions, to a hospital infant care review committee, to a pediatric only consultation service, to a combined adult/pediatric consultation service, with variable levels of salary support for consultants. Ethics consultation requests are growing at our institution. Similarities in identified ethical issues exist between our findings and existing literature, however meaningful comparisons remains elusive secondary to variability in approaches to investigation and reporting. A combined paid/volunteer/trainee ethics consultation service model appears sustainable and real time ethics consultation is feasible using this approach. (shrink)

There is a certain kind of tension in recent accounts of the role of reasons in virtue ethics between two plausible claims that pull in different directions. First, that virtues are the central normative notion in virtue ethics; and second, that virtue is a kind of responsiveness to reasons: that reasons explain both what it is to act from virtue, and what the virtues are. I argue that this is a serious tension and necessitates a different account of the relationship (...) between virtues and reasons; one that explains the distinctive normative contribution of virtue, central to virtue ethics, and that also captures the ways in which virtues structure practical reason itself and provide normative reasons for thinking, feeling, and acting. I develop a view, which I call virtues as reasons structure, that achieves these aims by drawing a theoretical and practical distinction between reasons from virtue and reasons for virtue. On this view, character traits explain what reasons a person has. A generous person, for example, is one who characteristically takes certain facts to be reasons for action; these are reasons from the virtue. Reasons for the virtues have a different role in theoretical and practical reflection in grounding claims with respect to which character traits to develop. I conclude by arguing that this view does not lead to a problematic kind of relativism and suggest further lines of inquiry. (shrink)

A new variety of empirical skeptical moral arguments have been put forward in recent years, drawing on data from neuroscience, social and behavioral psychology, and economics, which strongly suggest that emotions play a central causal role in moral judgment, and that reasoning has at most a limited supplementary causal role in small portion of moral judgments. It follows from these empirical finding, it is argued, that moral judgments and morality more generally cannot be grounded in reason in the right sort (...) of way to be rational. I argue that there are at least three distinct ways of understanding what it means to claim that moral reasoning is necessary to moral judgment. First, that moral reasoning is directly causally necessary to every moral judgment; second that moral reasoning is causally necessary to the ordinary development of the capacity for moral judgment, but is not directly causally implicated in every particular instance of moral judgment; and third that moral reasoning is necessary to a well-ordered capacity for moral judgment. I argue that the empirical data does support the claim that reasoning is not necessary to moral judgment in at least the first sense, perhaps in the second, but not in third, and that this is sufficient to provide for the rationality of moral judgments and morality more generally.
